16. 延期交貨和懲罰條約 Late Delivery and Penalty假如有一方沒能根據合同規定的交貨時間交貨，或者沒能完全履行合同，另一方的利益必然要遭到損害。延期交貨和懲罰條約就是為了預防出現利益糾紛而設置的。大家通過兩段例文來看看這個條約都要具體規定些什么：例1：假如乙方因自己緣由而未按時完工，乙方應對違約罰款，天天按總價的千分之一計算，即一千二百六十USD整。If party B fails to finish the work on schedule due to party B's own actions, he shall pay to the other party the penalty at 1 of the total value of the work per day, that is 美元 one thousand two hundred and sixty dollars.例2：假如合資一方未能按本合同第5條規定按期付款，違約方應在逾期后一個月付給另一方10%的利息。假如違約方逾期3個月仍未付款，合同另一方依據本合同第53條規定有權終止合同并向違約方索賠損失。Should either joint-venture fail to pay the contribution on schedule according to Clause 5, the default party should pay the other 10% of the interest one month after the deadline.
